Irv M
Irv M. Gross is a member of the Firm and is head of the Firm's Litigation
Department. His practice consists of representing both plaintiffs and defendants
in all phases of litigation, including appeals, involving a variety of business
matters: general business, corporate, commercial, employment, insolvency and
creditors' rights. Irv has successfully conducted jury and non-jury trials, both
in the state courts of California and the federal courts, as well as
arbitrations in complex litigation before the American Arbitration Association,
labor arbitrations, and mediations. His successful jury trials have included the
representation of a Fortune 300 company in a wrongful termination breach of the
duty of fair representation case, as well as the representation of former bank
directors sued for breach of fiduciary duty. Irv also has served as a Judge Pro
Tem (Los Angeles Superior Court).
Significant Representations
- Represented major employers and public companies, such as Interstate
Bakeries Corporation and Continental Baking Company, in employment
litigation and labor arbitration.
- Represented major corporations, such as McKesson Corp, Chicago Title
Insurance Company, Nutro Products, Inc. and Allstate Financial in business,
commercial and real estate litigation.
- Successfully defended prominent Los Angeles law firm in legal malpractice
actions.
- Represented Trustees, Chapter 11 debtors and Creditors' Committees in
insolvency litigation, such as Mr. Gasket (public company in
automotive parts business), Qintex Entertainment, Inc. (public
company in entertainment industry), and Condor Systems, Inc. (public
company in defense industry).
- Representing the prevailing party in First Pacific Bancorp, Inc. v. Bro,
847 F.2d 542 (9th Cir. 1988) (a landmark case in which the Ninth Circuit
Court of Appeals held that a proxy is not a security for purposes of
establishing liability under RICO).
- Represented the prevailing parties in the following published decisions: In
re Rossi, 86 B.R. 220 (9th Cir. BAP 1988); First Pacific Bancorp.,
Inc. V. Bro, 847 F.2d 542 (9th Cir. 1988); In re Qintex
Entertainment, Inc., 950 F.2d 1492 (9th Cir. 1991); Bergman v.
Rifkind & Sterling, Inc., 227 Cal. App.3d 1380 (1991); In re
Qintex Entertainment, Inc., 8 F.3d 1353 (9th Cir. 1993); In re Advent
Management Corp., 178 B.R. 480 (9th Cir. BAP 1995).
